  1. Triangle Images(TM) End User License Agreement:
  2. For the Triangle Browser Disc:
  3.  
  4. This is a legal agreement between you and Triangle Images ("Triangle"). 
  5. By using this CD-Rom you agree to be bound by the terms of this agreement. 
  6. If you do not agree, promptly return the CD package in the original 
  7. carton for a full refund. If you are entering into this agreement on 
  8. behalf of your employer, the license granted and restrictions and 
  9. limitations recited herein apply to your employer as well as to you a 
  10. representative of your employer. Should you cease working for your 
  11. employer, your employer may continue to operate under this agreement.

  13. Grant of License
  14. Triangle grants to you, and your employer if you are licensing on behalf 
  15. of your employer, a nonexclusive, nonsublicensable right to use any 
  16. software obtained from Triangle ("Software") and each Triangle Image 
  17. and any derivatives or copies thereof (collectively, an "Image" or the "Images")
  18. on your personal computer for Viewing and REFERENCE PURPOSES 
  19. ONLY.

  21. The Images may not be used, either inside or outside of your company, 
  22. in any other manner, including, but not limited to, in advertising or 
  23. marketing materials or in any online or other electronic distribution 
  24. system. The Images may not be disturbed, sublicensed or made available 
  25. for use or distribution, and no rights may be granted to the Images. 
  26. The Images, Software and disc may not be shared by creating a disc library,
  27. image storage jukebox, network configuration or similar 
  28. arrangement. You may not copy the Images or this disc. Pornographic, 
  29. defamatory, libelous or otherwise unlawful use of the Images is 
  30. prohibited.

  32. Additional Rights Available: if you are unsure of your usage rights 
  33. under this agreement, please contact Triangle, by mail at 
  34. license@triangleimages.com or by phone at 1 (877) 874-3456.

  36. Warranty
  37. Triangle warrants the Images, Software and disc to be free from defects 
  38. in material and workmanship for 90 days from delivery. The sole and 
  39. exclusive remedy for a breach of the forgoing warranty is the 
  40. replacement of the images, Software or disc or refund of the purchase 
  41. price, at Triangle's option. TRIANGLE MAKES NO OTHER WARRANTY, EXPRESS 
  42. OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF 
  43. MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  Some states do not 
  44. permit the exclusion of implied warranties and you may have other rights 
  45. which may vary from state to state. NEITHER TRIANGLE NOR ITS LICENSORS 
  46. SHALL BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY GENERAL, 
  47. SPECIAL, DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR OTHER DAMAGES 
  48. ARISING OUT OF THIS LICENSE OR OTHERWISE.

  50. General
  51. You may not decompile, reverse engineer, disassemble or otherwise reduce 
  52. to human-readable form any Software contained on this disc. All rights 
  53. to the Images, Software and disc are owned by Triangle and/or its 
  54. licensors and are protected by the United States copyright laws, 
  55. international treaty provisions and other applicable laws. Triangle and 
  56. its licensors retain all rights not expressly granted by this agreement. 
  57. The Images, Software and disc are licensed only to you or your employer 
  58. if you are licensing on behalf of your employer. However, this agreement 
  59. and the license to use the Image and Software may be transferred to 
  60. another person or legal entity if the following conditions are met: 
  61. you, or your employer if you are licensing on behalf of your employer, 
  62. (i) transfer the Image, Software and disc without keeping or storing any 
  63. copy, (ii) do not utilize any Image or Software in the future in any 
  64. manner, ( iii) transfer this physical agreement to the transferee, and 
  65. ( iv) the transferee agrees to be bound by the terms hereof. The license 
  66. contained in this agreement will terminate automatically without notice 
  67. from Triangle if you, or your employer, fail to comply wit any provision 
  68. of this agreement. Upon termination, you and your employer must 
  69. immediately (i) return the Images, Software and disc and all copies of 
  70. all of them to Triangle, and (iii) delete any images, Software and all 
  71. copies of all of them from all magnetic media and destroy all other 
  72. copies or, upon request of Triangle, return all such copies to Triangle. 
  73. Use of each Image and the Software must be in compliance with all 
  74. applicable law, including but not limited to, laws and regulations 
  75. relating to currency and the law of moral rights. Triangle reserves the 
  76. right to discontinue the use of any Image for any reason and elect to 
  77. replace the Image with an alternate Image. Upon notice of any 
  78. discontinuance of a license for a particular image, you, and your 
  79. employer and your client if applicable, agree not to use the Image in 
  80. the future. The Images, Software and disc are "Restricted Computer 
  81. Sofware" and, when provided to or for, or used on behalf of, the United 
  82. States of America, its agencies and/or instrumentalities (the U.S. 
  83. Government), are provided with "restricted rights". Use, duplication or 
  84. disclosure by the U.S. Government is subject to restrictions as set 
  85. forth under the United States copyright laws and this agreement, and as 
  86. provided in DFARS 227.7202-1(a) and 227.7202-3(a)(1995), 
  87. DFARS252.227.7013(c), FAR12.212(a)(1995), FAR52.227-19(a)-(d), as 
  88. applicable.
